Bryan Kohberger has autism, according to his lead defense lawyer, who is arguing the diagnosis means he should not face the possibility of the death penalty if he is convicted of the murders of a group of University of Idaho students who were killed in a 4 a.m. home invasion attack in November 2022.

“Bryan C. Kohberger, by and through his attorneys of record… hereby moves this Court to strike the death penalty as a sentencing option in his case because Mr. Kohberger’s autism spectrum disorder (ASD) reduces his culpability, negates the retributive and deterrent purposes of capital punishment, and exposes him to the unacceptable risk that he will be wrongfully convicted and sentenced to death,” Anne Taylor wrote in a newly unsealed, 28-page court filing.

She argued that repetitive behaviors such as rocking in place or Kohberger’s failure to make eye contact would be perceived by jurors as “strange, out-of-control, and even disrespectful of such a solemn proceeding” or interpreted as guilt or shame. She said her client had been examined by Dr. Rachel Orr, who found that Kohberger’s autism has a “significant impact on his daily life.”

“Mr. Kohberger’s ASD manifests in many of these highly prejudicial, but completely involuntary, mannerisms,” Taylor wrote. “Dr. Orr observed that he subtly rocks his upper torso, especially while engaged in a cognitive task or listening to someone else – both of which are almost certain to occur during his trial.”

Kohberger, 30, was studying for a Ph.D. in criminology at Washington State University at the time of the crimes.

He is accused of a meticulously planned attack that left four students dead at the University of Idaho, just 10 miles away. They were 21-year-old best friends Madison Mogen and Kaylee Goncalves, their 20-year-old housemate Xana Kernodle, and her boyfriend, Ethan Chapin, also 20.

Two other young women in the house survived the massacre, including one who told police she saw a masked man with “bushy eyebrows” leaving the house, possibly carrying a vacuum.

Taylor argued that Kohberger’s autism has resulted in “extreme inflexibility” and hinders him from participating in his own defense at trial.

“Mr. Kohberger displays extremely rigid thinking, perseverates on specific topics, processes information on a piece-meal basis, struggles to plan ahead, and demonstrates little insight into his own behaviors and emotions,” she wrote.

She claimed that her client’s communication skills are so inadequate that he is struggling to assist his own defense and that his lack of social awareness “will likely create an unwarranted impression of lack of remorse” before jurors.

She also renewed her criticism of widespread media coverage of the case, arguing that reporting on the “brutal and shocking” murders could outweigh autism as a mitigating factor at sentencing, if he is convicted, in the minds of jurors.

Separately, Taylor asked the court to bar prosecutors from using the diagnosis as an aggravating factor. 

“Because of his autism others may see Bryan as not recognizing social cues, continuing to talk to others when the conversation would naturally end, over-focusing on a topic or hobby of interest or talking about the same topic repeatedly, using a complicated vocabulary, or seeming self-absorbed,” she wrote. “Bryan’s autism is also accompanied by obsessive-compulsiveness, and an eating disorder.”

The filing is a long shot, however, according to legal experts. Judge Steven Hippler has already rejected a prior defense motion to strike the prosecution’s intent to seek capital punishment.

“Autism may be mitigation during the penalty phase of trial, but autism will not prevent application of the death penalty,” said Matthew Mangino, a former district attorney in Lawrence County, Pennsylvania, and an expert on capital punishment. 

Under current precedent, the death penalty would be barred against juveniles and people who are intellectually disabled, he said. Autism is not an intellectual disability.

“Not even severe mental illness” would spare a defendant in a similar case, he said. Additionally, prosecutors have noted in court filings that Idaho law does not have an insanity defense or allow mental condition to be a defense against charges. 

In a filing of their own, prosecutors asked the judge to block expert testimony about Kohbberger’s neuropsychological and psychiatric evaluations. 

“Kohberger’s motion is a valiant effort by his defense team to get the death penalty off the table – however, it will not be successful,” said Edwina Elcox, a Boise-based defense attorney whose past clients include Lori Vallow. “The assertion that Kohberger’s autism spectrum disorder reduces his culpability will not be sufficient to strike the death penalty in Idaho, the state which reinstated execution by firing squad in 2023.”

Trial is set to begin in Boise on Aug. 11 after years of delays and a change of venue.

Latah County Judge John Judge entered not guilty pleas on Kohberger’s behalf at his arraignment in May 2023.

As measles cases continue to emerge in several U.S. states, treatment and prevention is top of mind.

As most infected individuals have been unvaccinated, school-aged children, U.S. health agencies have stressed the importance of receiving two doses of the measles, mumps and rubella (MMR) vaccine to prevent the disease.

In a recent Fox News Digital op-ed, HHS secretary RFK Jr. shared his “deep concern” about the measles outbreak and its rapid escalation.

RFK noted that while there is no approved antiviral for measles, the Centers for Disease Control and Prevention released a statement last week supporting the administration of vitamin A under physician supervision as supportive care.

Previous research published in the International Journal of Epidemiology has shown that vitamin A, in conjunction with the measles vaccine, can be an effective intervention in preventing measles mortality in children.

RFK reiterated the importance of maintaining good nutrition and consuming various vitamins — like A, B12, C, D and E — as the “best defense against” chronic and infectious illness.

While studies have suggested that vitamin A can help fight a measles infection, Neil Maniar, PhD, MPH, professor of public health practice at Northeastern University in Boston, reiterated that it does not prevent the disease.

“The two-dose MMR vaccine is our safest and most effective tool to prevent this highly contagious illness,” he told Fox News Digital.

“Vitamin A can be helpful as part of a broader treatment protocol, especially in areas where children are deficient.”

Vitamin A can reduce the severity of measles symptoms, as well as the likelihood of mortality from the disease in individuals who are vitamin A-deficient, the expert noted.

“For children who are diagnosed with both measles and vitamin A deficiency, receiving age-appropriate doses of vitamin A may reduce the likelihood of progression to severe illness or death,” he added.

The expert warned that vitamin A can be harmful in high doses, so it’s “critical that vitamin A is not viewed as the primary course of treatment for all measles cases.”

Dr. Daniel Kuritzkes, chief of the Division of Infectious Diseases at Brigham and Women’s Hospital in Boston, stated that vitamin A deficiency is common in developing countries, coinciding with an increased measles mortality in those areas.

During an interview with Fox News Digital, Kuritzkes referenced research from the Harvard-Chan School of Public Health in 1993, which “favored a benefit” of vitamin A supplementation in the reduction of measles mortality for children in “resource-limited settings” or developing nations.

Saahir Khan, MD, infectious disease expert with Keck Medicine of USC in Los Angeles, agreed that vitamin A is not a direct treatment for measles.

“Rather, children who have vitamin A deficiency, as occurs primarily in resource-limited settings like sub-Saharan Africa, have been shown to have more severe disease manifestations from measles and can benefit from vitamin A supplementation to correct their underlying deficiency,” he echoed to Fox News Digital.

“Studies have not shown a clear, consistent benefit to vitamin A supplementation among patients in resource-rich settings like the United States who do not have underlying vitamin A deficiency.”  

Although vitamin A is “unlikely to harm the patient” in appropriate doses, Khan shared that controlled studies “do not support this practice.”

The CDC recommends vitamin A supplementation only under the guidance of a healthcare professional, which Kuritzkes said is “critically important” to ensure that the correct dose is administered.

“Inappropriate dosing can result in toxicity and a condition known as hypervitaminosi, a health problem caused by too much vitamin A,” he cautioned.

“Thus, people should not be administering generic vitamin A supplements purchased at a pharmacy or health food store to their children.”

Maniar, Kuritzkes and Khan all emphasized that vitamin A is not a vaccination alternative, as the MMR vaccine is the “most powerful tool” in preventing and controlling outbreaks.

“It is vital that we work in partnership with communities to educate individuals and families about the importance of the MMR vaccine and ensure that this vaccine is available to all who need it,” Maniar added.

President Donald Trump said he has notified Washington, D.C., Mayor Muriel Bowser that she needs to “clean up all of the unsightly homeless encampments” within the city or the federal government “will be forced to do it for her.”

In a Truth Social post on Wednesday, the president specifically referenced areas near the State Department and the White House that are populated with homeless encampments that need to be removed, adding that the nation’s capital “must become CLEAN and SAFE!”

“If she is not capable of doing so, we will be forced to do it for her!” Trump wrote, in part. “We want to be proud of our Great Capital again. Thank you Mayor Bowser for your efforts on behalf of the Citizens of our Country. Hopefully you will be successful!”

Trump has previously stated that he supports the federal government taking over the nation’s capital if it cannot be managed correctly, adding that the city cannot remain as it is when foreign leaders come to town.

“They’re not doing the job,” Trump said last month, arguing that there is “too much crime” and “too many tents on the lawns – these magnificent lawns.”

Despite his criticism of the city, Trump has said he likes the Democratic mayor personally. The two met in December to discuss their shared priorities for Washington, D.C., a moment that was described by Bowser as a “great meeting.”

“President Trump and I both want Washington, DC to be the best, most beautiful city in the world and we want the capital city to reflect the strength of our nation,” Bowser said in December.

“The mural inspired millions of people and helped our city through a painful period, but now we can’t afford to be distracted by meaningless congressional interference,” Bowser’s statement said, referencing a recently-introduced bill that calls for changing the plaza. “The devastating impacts of the federal job cuts must be our number one concern.”

Details surrounding a date for the plaza’s transformation were not given.

The MK-82 bombs “abnormally” released by the KF-16 fighter jet fell outside a firing range, causing unspecified civilian damages, the air force said in a statement.

The race comes after Mayor Eric Adams was indicted in September on federal corruption charges. He is now dealing with a tempest of criticism after Trump’s newly installed Justice Department leaders asked a court to drop the case, so Adams could assist with the federal government’s immigration crackdown.

A Dominican man wanted in his home country for human smuggling that resulted in the deaths of three minors was deported by ICE Miami earlier this week, according to U.S. Immigration and Customs Enforcement (ICE).

Batista Matos, 36, was sent home on an ICE removal flight for the fifth time on Monday. 

He departed Miami for Santo Domingo, Dominican Republic, where he was met by local law enforcement and taken into custody.

“The return of this fugitive to the Dominican Republic is a prime example of how ICE works closely with our international law enforcement partners to identify, locate and remove criminal aliens who are wanted in their country for allegedly committing crimes,” said ICE Enforcement and Removal Operations Miami acting Field Office Director Juan Lopez Vega.

Matos was first deported on Oct. 8, 2010, when U.S. Border Patrol agents encountered him near Cabo Rojo, Puerto Rico, after he had entered the territory illegally.

Though details of the encounters were not provided, ICE said he was also found and removed in 2011, 2019 and 2023.

He came into ICE custody on Feb. 6 and was transferred to Miami pending his removal.

“ICE prioritizes the arrest and removal of criminal alien fugitives. As a result, our communities are safer and more secure,” Lopez Vega said.

American authorities partnered with the Dominican National Police to return Matos to his home country, where he will face charges for his alleged crimes.

Trump acknowledged a letter he received from Zelenskyy after the dustup during a Tuesday address to a joint session of Congress.

“My team and I stand ready to work under President Trump’s strong leadership to get a peace that lasts,” the Ukrainian leader said in the letter, according to Trump. “We do really value how much America has done to help Ukraine maintain its sovereignty and independence.” 

Zelenskyy also said his country is ready to sign the mineral rights deal at any time. 

Rubio told Fox News host Sean Hannity the White House will continue to engage in diplomacy with both Russia and Ukraine to find out their demands and hopefully bridge the gap between the two to end the war.

The Institute for the Study of War (ISW), a Washington D.C.-based research group that closely monitors the shifting frontlines in Ukraine, said to date, neither Putin nor Kremlin officials have offered any meaningful concessions to end the full-scale invasion.

“They continuously repeat demands that amount to complete Ukrainian capitulation as well as the rolling back of NATO from Eastern Europe,” the ISW noted.

President Donald Trump is expected to issue an executive order, possibly Thursday, aimed at abolishing the Department of Education, The Wall Street Journal reported.

The newspaper cited several people briefed on the matter and reviewed a draft of the order. 

It directs newly sworn Education Secretary Linda McMahon to “take all necessary steps to facilitate the closure of the Education Department” based on “the maximum extent appropriate and permitted by law.”

Trump has long talked about dismantling the Department of Education, saying it has failed America’s students. 

“It’s a big con job,” the president said in November. “They ranked the top countries in the world. We’re ranked No. 40, but we’re ranked No. 1 in one department: cost per pupil. So, we spend more per pupil than any other country in the world, but we’re ranked No. 40.”

In a letter to Democratic members of the Senate Committee on Health, Education, Labor and Pensions (HELP), McMahon said that she “wholeheartedly” agreed with Trump’s plan to abolish the department. 

With around 4,500 employees, the department is the smallest cabinet-level agency, the Wall Street Journal reported. It is currently offering an incentive of up to $25,000 to the majority of its staff to resign or retire by Monday evening ahead of rumored work force reductions.

“President Trump believes that the bureaucracy in Washington should be abolished so that we can return education to the states, where it belongs. I wholeheartedly support and agree with this mission,” McMahon wrote.

Under McMahon, the department will work from three base convictions, according to her letter: that parents are the primary decision makers in their children’s education, that taxpayer-funded education should refocus on “meaningful learning in math, reading, science, and history—not divisive DEI programs and gender ideology,” and that post-secondary education should be a path to a well-paying career aligned with workforce needs.

A former New York detective who moonlighted by working for a mafia family and helped fuel a mini-mob war on Long Island while trying to protect its gambling operations was convicted Wednesday of lying to the FBI. 

Hector Rosario, 51, a former detective for the Nassau County police on Long Island, was also acquitted of obstruction of justice, the top charge he had faced. The verdict came after a seven-day trial in Brooklyn federal court.

“Hector Rosario cared more about lining his pockets with Bonanno family money and protecting his own interests than his fidelity to the law,” said Nassau County District Attorney Anne Donnelly. “He disgracefully compromised the investigative work of his fellow detectives by tipping off a target and lied to federal agents as the walls were closing in on him.”

Federal prosecutors said Rosario conspired to target rival Genovese family members in a feud that spilled out after the organized crime clans struck an unusual agreement to split the proceeds of a gelato shop’s backroom gambling den, the New York Post reported.

The Bonannos and Genoveses, two of New York City’s five mafia families, generally kept to their separate spheres during the 1980s and into the early 2000s, said a long-time mob investigator. 

The peace didn’t last long. Rosario even staged a fake police raid at a covert casino run by the Genoveses, prosecutors said.

U.S. Attorney John Durham called Rosario, a 15-year police veteran, a “corrupt detective” who chose loyalty to the mob “over the public he was sworn to protect.”

He was interviewed by FBI agents in 2020 as they were investigating Bonanno and Genovese criminal activity in the suburbs east of New York City. He falsely stated he had no information about the mafia or illegal gambling spots, authorities said. 

Rosario was fired from the force in 2022. He was among nine charged after federal authorities busted the gambling racket. 

His lawyers argued the case hinged on the unreliable testimony of mobsters now cooperating with prosecutors as they faced their own criminal charges.

The other mafia clans in New York are the Colombo, Gambino and Lucchese families.

Hunter Biden’s legal team recently filed a motion to drop his lawsuit against the ex-White House aide who published the contents of his infamous laptop, citing financial issues.

The motion, filed in Los Angeles Wednesday, pertains to the former first son’s lawsuit against Garrett Ziegler. The court documents, obtained by Fox News, illustrate the financial and personal issues Biden has experienced in the new year, including being a victim of the wildfires in the Pacific Palisades in Los Angeles.

Biden first filed the lawsuit in September 2023 but “does not have the resources to continue to litigate this matter,” according to the filing.

“Plaintiff has suffered a significant downturn in his income and has significant debt in the millions of dollars range,” the document states.

“Moreover, this lack of resources has been exacerbated after the fires in the Pacific Palisades in early January upended Plaintiff’s life by rendering his rental house unlivable for an extended period of time and, like many others in that situation, Plaintiff has had difficulty in finding a new permanent place to live as well as finding it difficult to earn a living,” the document states.

“So, Plaintiff must focus his time and resources dealing with his relocation, the damage he has incurred due to the fires, and paying for his family’s living expenses as opposed to this litigation.”

In another document filed Wednesday, Biden penned a letter explaining that his income “has decreased significantly” and revealed what he earned for his artwork.

“In the 2 to 3 years prior to December 2023, I sold 27 pieces of art at an average price of $54,481.48, but since then I have only sold 1 piece of art for $36,000,” Biden wrote. “Similarly, for my book sales, in the six month period before the statements (April 1, 2023 through September 30, 2023), based on the September 30, 2023 statement, 3,161 copies of my book were sold, but in the six months after the statements, only approximately 1,100 books were sold.”

Selling 27 pieces of art for an average price of $54,481.48 means he could have earned nearly $1.5 million on the artwork. The Yale Law School grad also wrote that he expected to land paid speaking engagements and appearances after the success of his book, “but that has not happened,” Biden wrote.

“This significant decrease in revenue has also impacted my ability to pay off my significant debt, which as has been reported in the press as being several million dollars. As a result of this, I am not in a position where I can borrow money.”

Elon Musk met with a small group of House Republicans on Wednesday evening where he discussed avenues for cost savings in a quest to find as much as $1 trillion in government waste, people familiar with the discussion told Fox News Digital.

“The executive DOGE team is confident, they think they can get $1 trillion,” one lawmaker familiar with the meeting told Fox News Digital. “Now, we’ll see, right? And the thing is, he acknowledged that we’re going to make mistakes, but we’re going to correct them very quickly.”

The GOP lawmaker said some concerns were raised about whether other government offices like the Treasury Department “have the bandwidth to do” what Musk is detailing. “And he says, ‘We’re gonna help them,'” the lawmaker said.

Multiple sources said Musk met with the House DOGE subcommittee led by Rep. Marjorie Taylor Greene, R-Ga., for about 45 minutes before a wider meeting with the House GOP Conference.

Several people said Musk pointed to areas where the government could be made more efficient, including an audit of how many dead people were de-listed off some federal benefits like Social Security but still had taxpayer dollars going into their accounts for unemployment or other programs.

“A lot of this is cross-referencing databases, making sure they’re talking to each other,” Rep. Michael Cloud, R-Texas, a member of the subcommittee, told Fox News Digital.

Two lawmakers present for the meeting also said the idea of a congressional rescissions package was floated as another way to claw back excessive government spending, as Republicans and Democrats battle over giving President Donald Trump leeway to spend less money than Congress appropriates.

Rescissions authority is granted to Congress to allow for the cancelation of some planned government spending.

“We had a very lengthy meeting, just my DOGE committee with Elon Musk and his team, and learned a lot of valuable information. The collaboration is going to be fantastic and it needs to happen,” Greene said.

Also present at both of Musk’s House meetings was his adviser Steve Davis, people told Fox News Digital.

After the smaller-scale meeting, Musk had a wider discussion with House Republicans where he spoke for roughly 15 minutes and then took questions.

“What we were doing was getting a deeper insight into what Elon Musk is doing and kind of being able to strategize with him, how we can coordinate what we’re doing,” Rep. Brandon Gill, R-Texas, who is also on the DOGE subcommittee, told reporters.

Rep. Mike Haridopolos, R-Fla., told Fox News Digital that “systematically there were no checks in order to make sure the taxpayer dollars were spent correctly.”

He said Musk did not discuss other fiscal battles ongoing in Congress, and that Musk “was just trying to outline what they are finding in a very short period of time and how little accountability exists in the operating system of our government.”

“It made me laugh and it made me sick all at the same time,” Rep. Dan Meuser, R-Pa., told Fox News Digital. “The level of waste and what they are finding is mindblowing.”

Rep. Ralph Norman, R-S.C., said Musk was “just getting started.”

“He just says, ‘I’m investigating and finding things that you really can’t argue with.’ He said he’s making mistakes, he’ll correct them, but his mission is to uncover where our tax money is. Let the chips fall where they may,” Norman said.

It comes as some House Republicans have faced contentious town halls or demonstrations related to Musk and DOGE in their home districts. GOP lawmakers previously shared frustrations with Fox News Digital that they were often left somewhat in the dark on Musk’s work. 

Rep. Derrick Van Orden, R-Wis., told reporters he aired similar concerns in the closed-door meeting. Musk was receptive to those issue, he added.

“I spoke to Elon specifically about this. There are our veterans and our farmers. So there’s a lot of angst going right now because people don’t understand what’s going on,” Van Orden said. “And I expressed very clearly the concerns of our veterans community. And Mr. Musk was explicitly clear that we will make sure that we have no degradation of the benefits for our veterans that they have earned.”

The back-to-back House meetings for Musk came after he spoke with Senate Republicans in a similar closed-door setting.
